Vietnamese Lawyers Declaration on Paracel - Spratly Matter

Declaration on the Matter of Paracel and Spratly Islands by the Association of Lawyers of Ho Chi Minh City


Due to the decision of the Chinese National Assembly on 2/12/2007 to establish the city of Tam Sa in the province of Hainan in order to directly administer the archipelagos on the South China Sea, among which are Vietnam’s Paracel and Spratly Islands;

Due to the fact that Vietnam has inviolatable sovereignty over Paracel and Spratly islands not only legally but also by de facto in accordance with international law; and

Due to the fact that sovereignty of Vietnam over the Paracel and Spratly islands has been clearly recorded in many documents and historical evidence from Vietnam, China, as well as internationally

The Association of Lawyers of Ho Chi Minh City declares that:

Firstly, the decision by the Chinese National Assembly to approve the establishment of Tam Sa is a denial of history and disregard for justice in relations to the matter of Vietnam’s sovereignty over the Paracel and Spratly islands.

Secondly, The Paracel and Spratly islands had been, are now, and will forever be inseparable and inviolatable territories of Vietnam both legally and by de defacto.
